SERVICE AGREEMENT

Trust Restatement

This Service Agreement ("Agreement") is made and entered into as of the date of purchase by and between:

  • Service Provider: Frontier Capital Trust, a private trust services firm, hereinafter referred to as “Service Provider.”
  • Client: The individual or entity purchasing the trust restatement consultation, hereinafter referred to as “Client.”

1. Scope of Services

Service Provider agrees to provide the following services as part of the Trust Restatement Consultation:

  • Reviewing and revising trust provisions to correct ambiguities, outdated language, or legally ineffective terms.
  • Ensuring compliance with current tax laws and regulations, preventing unintended legal or financial consequences.
  • Restructuring trustee and beneficiary roles to balance authority, prevent overreach, and clarify responsibilities.
  • Strengthening asset protection provisions to safeguard trust assets from lawsuits, creditors, and financial risks.
  • Refining the distribution plan to align with estate planning goals and prevent potential beneficiary conflicts.
  • Adjusting administrative provisions to ensure efficiency, reduce costs, and enhance trust management.
  • Addressing provisions that may be contrary to public policy, legally ambiguous, or unenforceable.
  • Providing a detailed summary and strategic recommendations to finalize the trust restatement efficiently.
  • Conducting a 30-minute consultation session via [platform name, e.g., Zoom, Kajabi, etc.].

This service does not include drafting legal documents, executing the restatement, or providing legal representation. Clients are advised to consult an attorney for document execution.


2. Fees and Payment

Client agrees to pay the full service fee of $2,499 at the time of booking. Payment is non-refundable except as outlined in the Cancellation Policy below.


3. Client Responsibilities

Client acknowledges and agrees to:

  • Provide accurate and complete information regarding their existing trust and estate planning goals.
  • Attend the scheduled session at the agreed-upon time and actively participate in the discussion.
  • Understand that this service is for strategic guidance only and does not constitute legal, tax, or financial advice.
  • Retain a qualified attorney to formally execute the trust restatement based on the consultation findings.

4. Rescheduling and Cancellation Policy

  • Rescheduling requests must be made at least 24 hours in advance of the scheduled consultation.
  • Cancellations made more than 48 hours before the session may be eligible for a partial refund, at the sole discretion of Frontier Capital Trust.
  • Cancellations made less than 48 hours before the session are non-refundable.

5. No Legal, Tax, or Financial Advice

Frontier Capital Trust is not a law firm, CPA firm, or financial advisory firm. This consultation provides strategic trust structuring insights but does not offer formal legal or tax advice.

Client understands that all recommendations are for informational purposes only, and it is their responsibility to consult with a licensed attorney or financial professional before implementing any suggested changes.


6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary, personal, or sensitive information shared during the consultation. However, no attorney-client privilege is established through this session.


7. Limitation of Liability

Frontier Capital Trust shall not be held liable for any decisions, financial outcomes, or legal actions taken by the Client based on the consultation. The Client assumes full responsibility for implementing any strategies discussed.


8. Governing Law

This Agreement shall be governed and interpreted under the laws of the State of [Insert State]. Any disputes arising from this Agreement shall first be attempted to be resolved through mediation before legal action is pursued.


9. Acknowledgment and Agreement

By purchasing this consultation, the Client acknowledges that they have read, understood, and agree to the terms of this Agreement.

  • Identify and correct vague or indefinite language that could lead to legal disputes.
  • Ensure compliance with current tax laws and regulations, preventing unintended tax liabilities.
  • Restructure trustee and beneficiary roles, especially if the trustee has excessive power or discretion that could lead to mismanagement.
  • Strengthen asset protection clauses to minimize risks from lawsuits, creditors, or financial instability.
  • Refine the distribution plan to avoid conflicts, ensure fairness, and better reflect your intent.
  • Adjust administrative provisions to prevent inefficiencies, high costs, or unnecessary restrictions on trust management.
  • Remove provisions that may be contrary to public policy, legally ineffective, or unenforceable under current law.

If your trust grants too much unchecked discretion to the trustee, lacks a clear distribution structure, or contains outdated administrative provisions, a professional restatement is essential. This session will ensure your trust is modernized, optimized, and legally enforceable to protect your estate and beneficiaries.
